Tax Information
Key Disclosures
- Sellers remain responsible for their own income, business, registration, invoice, and reporting obligations except where law expressly assigns collection, withholding, reporting, or remittance to intendle or a payment provider.
- Taxes shown at checkout may depend on the item, Seller, Buyer destination, legal status of the parties, and current law.
- Customs duties, import VAT/GST, brokerage charges, and similar destination charges may be payable outside checkout.
- Tax forms and reporting thresholds can change; receipt or non-receipt of a tax form does not determine whether income is taxable.
1. About This Page
This Tax Information page describes the categories of tax issues that may affect intendle transactions. It is not tax advice and is not a final statement that intendle will or will not collect a particular tax.
The Services are operated by intendle ("intendle," "we," "us," or "our"). The operator's registered legal details are available on request via legal@intendle.com.
2. Separate Responsibilities
A member-listed sale is a transaction between the Buyer and the identified Seller. intendle provides the platform and payment-routing technology. Tax law may nevertheless assign collection, reporting, withholding, marketplace-facilitator, recordkeeping, or other duties to intendle or Stripe even though intendle is not the seller under the purchase contract.
The allocation in this page does not change a mandatory tax rule.
3. Taxes That May Apply
Depending on the transaction, relevant taxes and charges may include:
- U.S. state and local sales or use tax;
- value-added tax (VAT) or goods and services tax (GST);
- tax on digital content or electronically supplied services;
- income tax and self-employment tax;
- business, franchise, gross-receipts, or similar tax;
- withholding tax;
- information-reporting obligations;
- customs duties, import VAT/GST, brokerage, and handling charges; and
- taxes on intendle membership or platform services.
4. Taxes Displayed at Checkout
Where intendle or Stripe must collect a tax, the amount should be calculated and displayed before the Buyer confirms payment. The order record should identify the tax amount separately where required.
An estimated or displayed tax may change if the delivery address, billing information, item classification, Seller status, exemption evidence, or law changes before finalization.
5. Texas Marketplace-Provider Analysis
Texas generally requires a marketplace provider engaged in business in Texas to collect, report, and remit state and local sales and use tax on marketplace sales.
6. Other U.S. States
Other states may impose marketplace-facilitator or remote-seller duties based on transaction type, physical presence, economic activity, destination, Seller location, or other factors. Requirements and thresholds can change.
7. EU and United Kingdom Digital Books
Digital books sold to consumers in the EU or United Kingdom may create VAT obligations based on the Buyer's location, Seller status, platform role, and applicable marketplace or deemed-supplier rules.
No digital-tax statement should be inferred from the fact that intendle's server is in Frankfurt. Server location and tax-supply rules are separate questions.
8. Physical Cross-Border Sales
A Buyer may owe customs duties, import VAT/GST, brokerage charges, or carrier fees when a physical item crosses a border. Unless law or checkout expressly states otherwise, these destination charges are the Buyer's responsibility and may be collected outside intendle.
The Seller remains responsible for accurate export and customs documentation and must not undervalue or misdescribe an item. Cultural-property, wildlife, sanctions, and export controls may apply independently of tax.
9. Seller Income and Business Taxes
Each Seller is responsible for determining and reporting taxable income and for any income, self-employment, business, franchise, gross-receipts, VAT/GST, or similar obligation allocated to the Seller by law. This duty applies whether or not the Seller receives an information form.
A Seller should maintain records of gross sales, refunds, shipping, taxes collected, payment-provider fees, intendle membership charges, cost basis, expenses, and other information required for the Seller's filings.
intendle does not determine whether a Seller acts as a hobbyist, professional, dealer, publisher, artist, business, or trader for tax purposes.
10. U.S. Information Reporting
Stripe, intendle, or another payment entity may request a taxpayer identification number and may issue or file a tax information form where required. Federal and state reporting thresholds and allocation between the platform and payment provider can change.
A form may be issued below a generally publicized threshold. A Seller must report taxable income regardless of whether a form is issued.
11. Taxpayer Identification and Withholding
A Seller must provide accurate tax information when required. intendle or Stripe may restrict payouts, apply backup withholding, or withhold other amounts where law requires or valid information is missing.
The Seller is responsible for keeping legal name, entity classification, address, residency, taxpayer number, and treaty or exemption documentation current.
12. Exemptions and Resale Certificates
A Buyer or Seller must not submit false exemption documentation.
13. Membership Charges and Faster Verification Review
intendle earns revenue through Seller membership charges, the paid faster verification review, and advertising where offered. The standard verification review is free. Those services may themselves be taxable in some jurisdictions.
14. Refunds and Tax Adjustments
When a taxable transaction is refunded, collected tax is adjusted according to applicable law. A partial refund must allocate tax consistently to the affected item and Seller.
15. Currency and Exchange Rates
Tax calculations, information returns, and accounting records may require conversion into a reporting currency. The responsible party must use a legally acceptable rate and retain the conversion record.
A Buyer's bank conversion or foreign-transaction fee is not a tax collected by intendle.
16. Seller Invoices and Buyer Receipts
An intendle order confirmation is not automatically a legally sufficient Seller tax invoice.
17. No Tax Advice or Guarantee
intendle does not provide tax, legal, accounting, or customs advice and does not guarantee the tax treatment of an item, Seller, Buyer, or payment. Users should consult qualified advisers in the relevant jurisdictions.
18. Changes and Current Law
Tax law, rates, thresholds, and agency guidance can change. This page will display a new version and Last Updated date when its content changes. A user should rely on the tax amount and disclosures presented for the specific transaction together with professional advice.
