Copyright and DMCA Policy

Version 0.1 · effective August 8, 2026

Key Disclosures

  1. Users may upload only material they own or are authorized to use. A Seller or portfolio owner remains responsible for text, artwork images, book files, covers, photographs, and other uploaded material.
  2. A valid DMCA notice must contain specific statutory information. Incomplete notices may delay action.
  3. A user whose material is removed may submit a compliant counter-notification. intendle may restore the material 10–14 business days after a valid counter-notification unless the claimant reports a filed court action.
  4. intendle must maintain and reasonably implement a repeat-infringer policy.
  5. The DMCA Designated Agent details are available on request via legal@intendle.com.

1. Purpose and Scope

intendle respects copyright and expects users to do the same. This Policy explains how a copyright owner or authorized agent may report material believed to infringe copyright, how the uploader may respond, and how intendle addresses repeated infringement.

The Services are operated by intendle ("intendle," "we," "us," or "our"). The operator's registered legal details are available on request via legal@intendle.com.

This Policy applies to user profiles, posts, artwork listings, book listings, digital book files, covers, reading samples, photographs, illustrations, messages where applicable, and other user-supplied material hosted through the Services.

2. User Responsibility

A user must not upload, publish, distribute, sell, or display material unless the user owns the relevant rights or has legally sufficient permission. This includes:

  • photographs of artworks or people;
  • book text, covers, illustrations, translations, and reading samples;
  • artwork images, reproductions, edition images, and installation photographs;
  • logos, trademarks, promotional graphics, and screenshots; and
  • music, audio, video, or other media if any such function is enabled.

Owning a physical artwork, book, print, or photograph does not necessarily transfer copyright. Appearing in a photograph does not necessarily give the person copyright in the photograph. Users must address both copyright and any separate privacy, publicity, or model-release rights.

3. Designated Agent for DMCA Notices

Notices under 17 U.S.C. § 512 should be sent to intendle's designated copyright agent:

A copyright owner or a person authorized to act for the owner should send a written notice containing all of the following:

  1. A physical or electronic signature of the copyright owner or the person authorized to act for the owner.
  2. Identification of the copyrighted work claimed to have been infringed. If one notice covers multiple works at one online location, provide a representative list that identifies them adequately.
  3. Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient for intendle to locate it. Include the exact intendle URL and, where useful, the profile, listing, post, title, image, or account name.
  4. Contact information reasonably sufficient to reach the complaining party, including full name, mailing address, telephone number, and email address.
  5. A statement that the complaining party has a good-faith belief that the disputed use is not authorized by the copyright owner, the owner's agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is the copyright owner or authorized to act for the owner.

A claimant should identify only material for which the claimant has a good-faith legal basis. A notice should not include unrelated private or sensitive information.

5. Submission Method

Send a DMCA notice to legal@intendle.com. The subject line should state “DMCA Copyright Notice.”

Email may be used for speed, but a claimant remains responsible for providing all legally required information. intendle may request clarification when a notice is incomplete, ambiguous, appears fraudulent, does not identify hosted material, or concerns a dispute outside copyright.

6. What intendle Does After a Notice

After receiving a notice, intendle may:

  • confirm receipt;
  • assess whether the notice substantially contains the required information;
  • locate and preserve relevant records;
  • remove or disable access to the identified material expeditiously where appropriate;
  • notify the affected user and provide the notice or a summary permitted by law;
  • explain the counter-notification process;
  • record the matter for repeat-infringer enforcement; and
  • take additional account or transaction action where the allegation also creates fraud, safety, authenticity, or legal risk.

Removal does not mean that intendle has finally determined ownership, infringement, or damages. intendle may refer disputed questions to the parties or a court.

7. Counter-Notification

A user who believes material was removed or disabled because of mistake or misidentification may submit a written counter-notification to the Designated Agent. It must contain:

  1. The user's physical or electronic signature.
  2. Identification of the material removed or disabled and the location where it appeared before removal.
  3. A statement under penalty of perjury that the user has a good-faith belief that the material was removed or disabled because of mistake or misidentification.
  4. The user's full name, address, and telephone number.
  5. A statement consenting to the jurisdiction of the appropriate United States federal district court—generally the district where the user's address is located, or, if the user is outside the United States, a federal district where intendle may be found—and accepting service of process from the person who submitted the original notice or that person's agent.

The counter-notification should be sent to legal@intendle.com with the subject “DMCA Counter-Notification.”

8. What Happens After a Counter-Notification

If intendle receives a substantially compliant counter-notification, intendle may provide a copy to the original claimant and state that the material may be restored.

intendle may restore the material or cease disabling access not less than 10 and not more than 14 business days after receiving the counter-notification unless the Designated Agent first receives notice that the claimant has filed a court action seeking an order to restrain the user from the allegedly infringing activity.

intendle may keep material unavailable for another independent policy or legal reason even if the DMCA restoration process would otherwise permit restoration.

9. Repeat-Infringer Policy

intendle will maintain and reasonably implement a policy for terminating, in appropriate circumstances, users who repeatedly infringe copyright. intendle may consider valid notices, court findings, admissions, repeated unauthorized uploads, counter-notification outcomes, retractions, and other reliable evidence.

A strike is recorded only when a copyright complaint is received and upheld, meaning the uploader cannot show any right in the work. Reselling a work you lawfully own, or selling a work you are authorized to sell as a dealer or gallery, is never a strike. After a first upheld complaint the member receives a formal warning and one further chance. On a second upheld complaint the account is closed permanently.

A single serious, deliberate, commercial, or fraudulent infringement may support immediate action under other policies even before a repeat threshold is reached.

10. Retractions and Resolved Disputes

A claimant who wishes to retract a notice should write from the same contact address, identify the original notice and affected material, and state clearly that the complaint is withdrawn. intendle may verify the retraction before restoring material or adjusting an infringement record.

A private settlement does not automatically require restoration if another law or policy still prevents the material from appearing.

11. False or Misleading Notices

A person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may face liability under applicable law. Submitting fabricated documents, impersonating a rights owner, or using the process to harass a user violates intendle policies.

intendle may preserve and disclose relevant records where lawfully required.

12. Other Intellectual-Property Complaints

Trademark, right-of-publicity, privacy, moral-rights, counterfeit, authorship, and contractual-rights disputes are not automatically DMCA matters. A complaint should identify the legal right, the exact material, the complainant's authority, and the requested action and should be sent to legal@intendle.com.

intendle may request a court order, registration record, authorization, identity evidence, or other documentation where the dispute cannot be resolved from the submitted material.

13. Photographer Complaints

A user who uploads a photograph of a person must have permission both from the person depicted and from the copyright owner of the photograph. A photographer may use the process in this Policy if the complaint concerns copyright.

14. Preservation, Privacy, and Disclosure

intendle may retain notices, counter-notifications, decisions, account identifiers, URLs, evidence, and related communications as needed to operate the process, enforce the repeat-infringer policy, defend legal claims, and comply with law. A notice or counter-notification may be shared with the opposing party, counsel, service providers, or authorities as legally appropriate.

The Privacy Policy governs personal-data handling. A party should understand that statutory notices contain identifying and contact information that may be disclosed to the other party.

This Policy describes an operational process and does not provide legal advice. Parties should consult qualified counsel about fair use, licensing, ownership, statutory damages, jurisdiction, counter-notifications, or litigation.

16. Changes to This Policy

A revised Policy will display a new version and Last Updated date. Material process changes will be implemented prospectively and will not prevent intendle from complying with a statutory obligation applicable to an existing matter.
